By creating a DJ Berthiot account, you agree to use the platform lawfully, accept that subscriptions are billed monthly via Stripe (no refunds except where required by law), and acknowledge that you own the content you generate. Cancel anytime — access continues until the end of the period.

1) Introduction

These Terms of Service ("Terms") govern your access to and use of the DJ Berthiot platform (the "Service"), operated by Berkerm LLC, a Wyoming Limited Liability Company, 30 N Gould St Ste R, Sheridan, WY 82801, USA ("Company", "we", "us"). By creating an account or using the Service, you agree to these Terms.

2) Service overview

Purpose: create and manage AI influencers, generate AI-powered images, short videos, and chat with a persona — for music artists, brands, and creators.

1 image generation = 1 credit. 1 five-second video = 25 credits. Chat messages are free.

  • Free plan ($0): 20 image credits one-time, 1 influencer.
  • Pro ($19/mo): 200 image credits + 5 video credits per month, 1 influencer, unlimited chat, commercial license.
  • Studio ($49/mo): 700 image credits + 30 video credits per month, 3 influencers, early access to new features.
  • Label ($199/mo, contact us): 3,000 image credits + 200 video credits per month, 10 influencers, multi-account dashboard, API access — by application only.
  • No rollover: unused credits do not roll over to the next billing cycle.
  • Overage: image $0.10 / credit, video $0.80 / credit beyond plan (opt-in only).

3) Account & eligibility

  • You must provide accurate account information (name, email).
  • You are responsible for safeguarding your credentials and all activity under your account.
  • You must be at least 13 years old (or the minimum age in your jurisdiction).
  • We may suspend or terminate accounts for abuse, fraud, or violations of these Terms.

4) Payments & subscriptions

  • Subscriptions are billed through Stripe. We do not store card credentials on our servers.
  • You may cancel anytime via your account page; access continues until the end of the current billing period.
  • No refunds except where required by applicable law (EU 14-day cooling-off does not apply once you have consumed credits — by starting a generation you expressly waive this right).
  • Credits are consumed by image and video generation. Unused credits are forfeited at cycle end.
  • Taxes: prices shown exclude VAT. Where required by your jurisdiction (e.g. EU), applicable taxes will be added at checkout. Berkerm LLC issues invoices on request via besounder@gmail.com.

5) Acceptable use

You agree to follow our Acceptable Use Policy and Content Policy. Briefly, you will not use the Service to:

  • Violate any applicable law or third-party rights.
  • Generate sexually explicit content involving minors, non-consensual intimate imagery, or content depicting real people without documented written consent.
  • Generate harassing, defamatory, hateful, or violent content targeting individuals or groups.
  • Impersonate real public figures or living persons in a misleading manner.
  • Attempt to reverse engineer, scrape, or disrupt any part of the Service.

6) Intellectual property

  • The Service (software, design, branding) is owned by the Company.
  • You retain rights to AI-generated outputs you create with paid plans (commercial license included). You are responsible for ensuring your use does not infringe third-party rights, including image rights, trademarks, and copyrights.
  • Free-plan outputs are licensed for personal use only.

7) Data & infrastructure

  • Account data: stored in Supabase (Postgres with row-level security).
  • Frontend: hosted on Vercel (global edge network).
  • Generated media: stored in Supabase Storage with CDN delivery.
  • AI models: image generation via Replicate (Nano Banana, Flux 1.1 Pro) with FAL fallback; video via Kling v1.6 on Replicate; chat via DeepSeek.
  • Dictation: Whisper ONNX runs in your browser — audio never leaves your device.
  • Payments: processed by Stripe; we receive subscription metadata only.

8) Termination

We may suspend or terminate access for violations of these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately; no refunds are provided except where required by law.

9) Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation. AI-generated outputs may contain inaccuracies and should be reviewed before use.

10) Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

11) Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws rules. Any disputes shall be resolved in the competent courts of Wyoming.

12) Changes to terms

We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date. Continued use constitutes acceptance of the revised Terms.
